Maternity insurance in China for foreign employees
Separate participation, active entitlement, maternity medical expenses and allowance before relying on payroll deductions or a social-security card.

China's national rules require qualifying foreign nationals who are legally employed in China to participate in the listed employee social-insurance branches, including maternity insurance. That statement is a starting point, not an individual promise. A lawful work document, employment contract, payroll deduction, social-security number, social security card and active employee basic-medical-insurance record can each be relevant, but none alone proves that a particular maternity medical expense or allowance is payable. Participation must be connected to the correct employer or China-based work unit, identity, pooling area and contribution record; active benefit conditions then come from the current rules of that locality. Maternity medical expenses and maternity allowance are separate benefits, and commercial insurance remains a separate contract. This guide is administrative information only. It does not determine eligibility, calculate an allowance, interpret an international agreement for an individual, choose clinical care or give pregnancy advice.

Begin with the legal participation category, not nationality alone
The revised foreign-participation measures describe the covered foreign employee as a non-Chinese national who is legally employed in China with the specified work and residence documents, or who holds a foreign permanent-residence document and works lawfully. They cover two common structures: direct employment by an organization registered or recorded in China, and dispatch by an overseas employer to a branch or representative organization registered or recorded in China. In the first structure the China employer registers the employee; in the second the China-based work unit carries that duty. The measures list employee basic medical insurance and maternity insurance among the required branches.
Do not reverse that definition. A passport, visa, temporary stay, dependent residence status, study status, property ownership, tax payment, freelance contract, overseas payroll or private insurance card does not by itself establish participation under the foreign-employee measures. A foreign spouse or child is not automatically attached to the employee's maternity-insurance record. A person working remotely for an overseas entity without the covered China employment structure should obtain a formal determination rather than asking HR to imitate an employee registration. Permanent residence can satisfy an identity-document part of the definition, but it does not replace actual lawful employment or the local participation record.
Ask the employer to identify the legal employing or China-based work unit, the employment document used, the date the social-insurance registration was submitted, the registered pooling area and the participant's social-security number. Then verify those facts through the responsible official record. This is more reliable than asking only whether the company 'provides insurance.' The phrase may refer to public social insurance, an employer-funded commercial plan, a medical allowance or a broker service, which have different legal and payment consequences.

Understand what integration with employee basic medical insurance does—and does not—mean
The national merger framework retained maternity insurance and its benefits while integrating administration with employee basic medical insurance. In-service employees who participate in employee basic medical insurance participate in maternity insurance synchronously under that framework. Registration, fund operation, employer contribution management, designated medical-service management, agency service and information systems are coordinated. This is why an HR team or healthcare-security office may describe the coverage as employee medical insurance 'including maternity insurance' rather than show a separate individual deduction line.
Integration does not erase the benefit boundary. The Social Insurance Law continues to identify maternity medical expenses and maternity allowance as maternity-insurance benefits. Ordinary basic-medical expenses, maternity medical expenses, expenses governed by another benefit category and self-funded services can appear in the same episode without being the same claim. A hospital system may route some eligible maternity charges through direct settlement and classify other charges under ordinary medical insurance or personal payment according to local rules. A card or medical insurance code can identify the participant without proving which route a charge will take.
The contribution structure also needs precise language. National law says the employer pays maternity-insurance contributions and the employee does not pay a separate maternity-insurance premium. After integration, a payroll statement may show only a combined employee basic-medical-insurance line or no separately named maternity amount. Do not treat the absence of a personal maternity deduction as proof of non-participation, and do not treat any payroll deduction as proof of active benefits. Ask for the scheme name, contribution status, effective month and whether the employer account is current in the responsible pooling area.
Administrative integration reduces duplicate systems; it does not make every employee-medical-insurance charge a maternity benefit or make local entitlement conditions disappear.
Separate registration, contribution history and active entitlement
Build a three-column status record. Registration answers whether the person exists under the correct employer, social-security number, passport identity and local maternity-insurance scheme. Contribution history answers which months the employer reported and paid and whether the record shows arrears, interruption, correction or another status. Active entitlement answers whether the current locality recognizes the participant as eligible for the specific maternity event and date. These columns can disagree. A person can be registered but not yet satisfy a local contribution condition; an employer can submit payroll while the identity is mismatched; a historical participant can hold a card while current employment has ended.
National sources intentionally do not state one contribution-month threshold or one rule for retroactive employer payment. Provinces and pooling areas determine detailed foreign-worker maternity handling and local benefit conditions. Ask the healthcare-security agency for the rule in force on the relevant date, not a screenshot from another city or a colleague's earlier pregnancy. Use neutral questions: Is the employee registered in employee basic medical insurance including maternity insurance? What is the current status and insured place? Which contribution and continuity conditions apply to maternity medical expenses? Which apply to maternity allowance? Which event date controls each decision?
Record the official answer, date, source, policy title and case or enquiry number. If HR and the healthcare-security record conflict, do not ask the hospital to adjudicate the employer contribution file. The hospital can usually see only the settlement response it receives. Ask HR to correct employer reporting and ask the agency to confirm when the participant record becomes accurate. A later correction may or may not restore a benefit for an earlier event; obtain an individual decision instead of promising retroactive coverage.

Treat treaty or agreement exemptions as narrow, documented exceptions
The foreign-participation measures provide that a person from a country with a social-security agreement with China is handled according to that agreement. The 2025 inter-ministerial expatriate guide also describes exemption for specified insurance branches and periods when the applicable agreement and evidence support it. The operative words are specified and applicable. Agreements differ in the people, branches, maximum periods, certificates and procedures they cover. Some agreements focus on pension or unemployment branches and do not exempt employee basic medical or maternity insurance.
Nationality is therefore only the first screening fact. Ask the employer which agreement article and branch it relies on, whether the person falls within the covered worker category, which competent institution issued the certificate of coverage, what period the certificate covers and whether the Chinese agency accepted it. A colleague of the same nationality may have a different assignment structure, certificate period or employing entity. An expired, unsubmitted or branch-limited certificate cannot safely be treated as a continuing maternity-insurance exemption.
Keep the agreement analysis separate from benefit analysis. If maternity insurance was not exempted, verify normal participation and local entitlement. If it was exempted under a valid determination, do not assume public maternity benefits remain available despite no participation; ask the responsible agency and review commercial or employer arrangements separately. This guide cannot interpret a treaty or certificate for a person. The defensible record is the current official agreement text plus the individual certificate and the Chinese agency's accepted status.
Never write 'citizens of country X do not pay China social insurance.' Identify the covered worker, insurance branch, certificate and period in the applicable agreement.
Map maternity medical expenses and maternity allowance as separate benefits
The Social Insurance Law divides maternity-insurance benefits into maternity medical expenses and maternity allowance. National public guidance describes the medical-expense side broadly as eligible prenatal examination, inpatient childbirth and family-planning medical expenses, while local rules determine the payable method and detail. The allowance is income support connected to qualifying maternity leave or specified leave events. One successful benefit does not automatically approve the other. A hospital can directly settle eligible medical expenses while an allowance application is pending, returned or ineligible; an allowance can be approved even though some hospital charges remain self-funded.
Create two files from the beginning. The medical-expense file should identify active status, any local maternity-care confirmation, the exact designated provider, accepted identity and credential, direct-settlement result, receipts, itemized list and any manual reimbursement route. The allowance file should identify the employer, relevant local contribution and event-date conditions, leave or event record, clinical-administrative evidence required by the agency, applicant, payee, bank account, application reference and agency result. Do not merge them into one folder labelled 'reimbursement' and assume the same deadline or payer.
The employer has a role in registration, contributions, employment and possibly submission or payroll reconciliation. The healthcare-security agency determines public benefit eligibility and payment under the applicable rules. The hospital supplies care and records and may process direct settlement. A bank receives an approved payment. A commercial insurer applies its contract. Assign each question to the owner: HR cannot guarantee fund payment, the hospital cannot rewrite contribution history, and a commercial insurer cannot activate public maternity insurance.

Verify the local provider-confirmation and settlement route before planned care
The national merger opinion says maternity medical expenses should in principle be directly settled between the healthcare-security agency and designated medical institutions. That principle still requires a functioning local route. Depending on the locality, a participant may need to use a maternity-qualified designated institution, complete a medical or maternity-care confirmation, select or register a provider, present an accepted credential or complete another administrative step. National sources do not authorize this guide to name one document, app, mini-program or timing rule for every city.
Ask the local healthcare-security agency and exact hospital campus four separate questions. First, is the participant's maternity benefit active? Second, is the exact legal institution and campus designated for this scheme and service? Third, is a provider selection, medical confirmation or other registration required before eligible maternity services can settle? Fourth, which identity document and credential can a foreign passport holder use at registration and settlement? Save the hospital's answer with the staff unit and date; a general hospital logo or maternity department webpage is not an insurance confirmation.
For a medical emergency in mainland China, call 120 or follow the hospital's emergency route first. Do not delay rescue to complete an insurance registration, provider selection or app activation. Tell staff about the participant's insurance and identity as soon as safely possible and ask about the administrative route after urgent care has begun. Emergency access, clinical acceptance, maternity-insurance classification, ordinary medical-insurance treatment and later reimbursement are separate decisions. This guide cannot tell a person whether a symptom is an emergency.

Use the employer as a record owner, not as the final benefit authority
Ask HR or payroll for a concise participation certificate or record rather than a broad assurance. Useful fields are the legal employer or China-based work unit, insured place, scheme, registration date, social-security number, passport or permanent-residence identity used, contribution months, any interruption and the current local agency contact. Ask whether the employee appears in employee basic medical insurance including maternity insurance and whether an employer-side correction is pending. Protect full identifiers; an ordinary email or group chat should not contain more passport and medical data than necessary.
Then ask who performs each later action. Some local systems let the hospital's settled data start an allowance process; some require the employer to submit; others permit or require the participant to act. Direct payment to the individual nationwide does not make the employer irrelevant. HR may still confirm employment, leave, contribution or enterprise information and must reconcile public allowance payment with payroll under current local and employment rules. The agency, not a manager, decides the fund claim.
If an employer has not registered the worker, has reported the wrong identity or has contribution arrears, request a written correction plan and official case reference. Do not falsify an employment date, ask the hospital to bill another person's record or submit a duplicate claim to bridge the gap. A delayed employer correction can have benefit consequences that this guide cannot predict. The employee may seek the responsible social-insurance, healthcare-security or labour-administration service for case-specific handling and, where needed, independent legal advice.
Keep spouses, male employees and other schemes in separate lanes
Employers enrol eligible employees regardless of sex; participation is not limited to the employee who may give birth. The Social Insurance Law also states that an employee's unemployed spouse can receive maternity medical-expense treatment according to national rules. That does not establish a universal spouse attachment, allowance entitlement, amount, document set or foreign-spouse route. Local rules can distinguish the employed participant's benefits, an unemployed spouse's medical-expense benefit, resident basic-medical-insurance childbirth treatment and other categories.
Before relying on a spouse route, identify whose employment and insurance record is being used, whether the spouse is genuinely outside employment, whether the spouse has another public scheme, which locality administers the claim, what expenses are included and whether duplicate treatment is prohibited. Do not assume that a male employee's participation creates maternity allowance for a spouse. Do not move a person between employee, resident and spouse routes solely to obtain a more favourable result without an official eligibility decision.
Foreign dependants, international students, accompanying family members and people outside covered employment need their own insurance analysis. A residence permit or family relationship does not automatically enrol them in employee maternity insurance. They may have a locally available resident-insurance route, another public route, employer-sponsored commercial cover or self-payment, but access depends on current local eligibility and contract terms. This guide deliberately does not generalize from employee rules to those groups.
Male employees participate, but participation is not the same as a universal spouse allowance. Ask the locality to identify the exact spouse or dependant benefit route.
Keep commercial insurance and employer benefits contractually separate
An international health policy, employer private medical plan, travel policy, maternity rider, cash allowance or direct-billing card can coexist with public maternity insurance. None creates public participation, changes the public contribution record or binds a healthcare-security agency. Conversely, an active public record does not prove that a commercial policy covers pregnancy, childbirth, newborn care, a waiting period, a named hospital or the patient share left after public settlement.
Ask the insurer or claims administrator for the policy-specific maternity limit, waiting period, covered person, network, pre-authorization, direct-billing or reimbursement route, exclusions, document list, coordination-of-benefits rules and deadline. Ask whether the insurer requires the public settlement statement before considering the residual amount. Do not describe a guarantee of payment as final coverage, and do not assume a hospital's agreement with one insurer applies to every plan, campus or service.
Maintain separate transaction records. Public direct settlement should produce a medical-insurance settlement statement or equivalent local record. A public manual claim needs unaltered official evidence. The commercial claim may need copies or verified electronic records and should disclose other payment sources truthfully. Never claim the same expense twice without the payer's rules expressly allowing coordination. If the employer offers a separate childbirth cash benefit, record it outside both insurance ledgers.
Build a verification record that can survive policy and job changes
Maternity-insurance administration can span registration, planned hospital use, the insured event, discharge, allowance processing and later correction. Keep a secure timeline with the employer, pooling area, scheme, registered identity, contribution months, local policy title, confirmation reference, provider, settlement result, manual-claim reference, allowance application, bank destination and final payment. Use masked identifiers in the working log and keep full copies in protected storage. Record policy effective dates because the rule in force on the event date may differ from the rule on the application date.
Review the file after a passport renewal, work-permit change, employer transfer, city move, leave from employment, contribution interruption or bank-account change. Those events do not update every system automatically. Ask the record owner to confirm the change and whether an open maternity medical-expense or allowance case is affected. Do not close an old bank account, discard an old passport link or terminate a prior employer contact until pending payments and corrections are resolved.
The most reliable final question is not 'Do I have maternity insurance?' Ask instead: Under which local scheme and identity am I registered; is my entitlement active for this event; what confirmation and provider route applies; how will eligible medical expenses settle; who submits the allowance; where will an approved payment go; and what evidence must I retain? That seven-part answer is specific enough to act on and narrow enough for each organization to confirm.
