Cancel residence and work documents after a foreigner dies in China
Close immigration and employment records without confusing them with consular notice, hospital files, insurance claims or estate and property administration.

A foreign national's death creates several closure files in China, and none should be treated as the master cancellation. The family, guardian or agent reports the death to county-level-or-above public-security exit-entry administration and cancels the person's stay or residence document. If the deceased held a foreigner's work permit, the employer uses the separate work-permit system and should apply within the stated ten-working-day period. The relevant consulate may receive notification and handle nationality-specific passport or consular records. The hospital retains its own medical records and billing file; the insurer and employer each need only the evidence required for their task; and bank accounts, leases, personal property, payroll, tax, social insurance, company interests and digital assets can involve estate authority and legal advice. This guide organizes responsibilities and evidence. It does not determine inheritance, beneficiary rights, debt priority, employment compensation, tax liability, data ownership or who is legally entitled to collect property.

Create one closure register with separate owners
Start a table with the task, authority, case number, applicant, evidence, original-document holder, deadline and result. At minimum, include death proof, public-security exit-entry declaration, stay or residence cancellation, work-permit cancellation where applicable, consular notification, funeral or repatriation file, hospital records and account, insurer claim, employer or school file and estate or property matters. A single relative can coordinate them, but each institution remains responsible for its own decision.
Do not hand every original to an employer or funeral agent because that party is helping. Identify which office needs the original, whether a certified copy is acceptable and when it will be returned. Keep the deceased's passport, death proof and representative authority in a controlled inventory. If an original is surrendered, obtain a receipt showing the document, holder, purpose and return or cancellation status.
Obtain and verify the underlying death proof
The national death-certificate rules effective 1 July 2026 expressly cover foreign and stateless people who die in mainland China. A normal death follows the responsible medical or community-health route; a public-security-handled non-normal death uses the appropriate police proof. Check the deceased's full name, passport number, nationality, sex, dates and place before using the certificate for immigration, work, consular or overseas processes.
If a core identity field or recorded fact is wrong, ask the original issuer about correction under the national procedure before making multiple translations or filings. Do not edit a scan or ask HR to use a preferred spelling that differs from the official record. Keep the cause-of-death information more restricted than the basic death and identity information unless a particular authority, insurer or legal process requires it.
Report the death to public-security exit-entry administration
Article 40 of the Exit and Entry Administration Law requires the family, guardian or agent to report a foreign national's death with the death proof to a county-level-or-above public-security exit-entry administration and cancel the person's stay or residence document. Ask the local authority which office has jurisdiction, whether an appointment is needed, which original identity documents and representative materials are required and what result or receipt it issues.
The national enforcement guidance identifies failure to report within 60 days after the foreign death proof is issued as the relevant offence. That wording should not be presented as permission to wait. Immigration closure can be needed for funeral transport, passport handling, employer files and accurate government records. Contact the authority promptly, record any reason for delay and use the national 12367 immigration service for an official routing enquiry where the local office is unclear.
Death proof establishes the underlying event. The exit-entry office's cancellation action closes the stay or residence record. Keep both records.
Do not confuse residence-document cancellation with border or Customs clearance
Cancelling a stay or residence document is an immigration act concerning the deceased person's China status. It does not release a body from public-security control, authorize cremation, appoint the international remains operator, complete Customs health quarantine or create an airline cargo booking. The funeral or repatriation team may ask for evidence that immigration closure is complete, but the evidence remains one part of a larger file.
If the passport is held by public security, a consulate, hospital safe, employer or family member, ask the exit-entry office what it needs and whether it retains, marks or returns any document. Do not surrender the passport to an informal broker who promises to cancel every record. Passport invalidation or consular handling is a nationality matter, while Chinese stay or residence cancellation belongs to the Chinese public-security authority.
Have the employer cancel the foreigner's work permit
The published work-permit service route states that where the foreign applicant has died, the employing unit should apply to the competent deciding authority within ten working days. The employer normally files the work-permit cancellation form and evidence connected to the reason through the foreigner work-management service. Ask HR to identify the exact authority, system submission date, uploaded death evidence and cancellation result.
Work-permit cancellation and work-type residence cancellation are not the same transaction, even when a city offers an integrated service. Preserve the work-permit cancellation certificate or system result separately from the public-security receipt. If the deceased's work-permit information was integrated with the social-security card, ask the competent employment and social-insurance channels what additional records must be closed; do not assume the physical card's collection cancels every linked entitlement.
Track the employer or school's separate reporting duty
The regulations on administration of foreigners require employing units and educational institutions to report specified events involving foreign employees or students, including death or disappearance. Ask the employer or school to state which public-security report it made, when and under which case or acknowledgement. This institutional duty can run alongside the family, guardian or agent's Article 40 declaration; one should not be used as an excuse to omit the other.
Define the organization's authority narrowly. It may secure workplace belongings, maintain payroll and benefit files, contact the family, communicate with an insurer, cancel a work permit or help obtain records under accepted authorization. It does not automatically become the estate administrator, next of kin, funeral decision-maker or owner of the deceased's passport, medical file, bank account or personal devices.
Notify the consulate and define its document role
Under the Vienna Convention on Consular Relations, the receiving state's authorities should notify the relevant consular post without delay when they learn of a foreign national's death. The family or representative should also contact the consular service and provide the case location, identity, local authority contact and chosen communication person. Ask whether the consulate needs the original passport, death proof, next-of-kin instruction or a local police document.
The consulate may contact relatives, explain local options, issue or arrange a nationality-specific consular report of death or mortuary document and address the deceased's passport according to its own law. It does not replace Chinese public security, the work-permit authority, the funeral home, Customs or a court. Official UK and U.S. guidance also makes clear that consular services normally do not pay funeral, repatriation, translation or legal costs.
Close the hospital record and billing files separately
Ask the hospital's medical-record office how a deceased patient's legal heir or authorized agent can request named materials. The 2013 national rules provide for identity, death, relationship and authority evidence and identify copyable items such as admission, operation, pathology, laboratory, imaging and discharge records. A stamped record copy is different from a death certificate, itemized bill, invoice, deposit refund, medical dispute file or overseas-certified document.
Contact the cashier or finance office separately for the final itemized account, official receipts, deposit balance and refund route. Record the patient number, encounter, payer, bank or card used and person authorized to receive a refund. An insurer may request medical records under its own evidence route, but HR or an assistance company should not receive the entire chart merely because it is coordinating payment. If the hospital requires an heir or agent to appear, ask what lawful remote authorization it accepts.
Build the insurer and assistance-company file
Notify the insurer or assistance company using its official emergency or claims channel. Ask it to separate benefits and costs: medical expenses before death, local funeral services, storage, body repatriation, local cremation, ashes transport, family travel, translation and destination funeral expenses can have different limits, exclusions and preauthorization rules. Obtain the claim reference, document list, submission deadline and payment recipient in writing.
Give the insurer only the necessary death, medical, billing, relationship and authority evidence. The medical-record rules provide a specific route for insurers and, after death, require the relevant contract and authorization evidence unless another legal rule applies. An insurer's guarantee or reimbursement decision does not cancel immigration documents, authorize disposition, release the body or determine inheritance. Record any original it receives and its return policy.
Close the employer file without treating HR as the estate
Ask HR for an inventory of final salary, unpaid reimbursement, leave balance where relevant, employer-provided insurance, pension or benefit plan, tax documents, work equipment, housing, deposits, personal belongings and named beneficiary records. The employer should identify the legal or contractual basis and the evidence required for payment or handover. A payroll amount shown in HR software does not establish who inherits it, and a nominated insurance beneficiary may differ from the estate representative.
Preserve the employment contract, work-permit cancellation result, payslips, expense claims, benefit booklets, employer correspondence and property inventory. Do not sign a broad release in an unfamiliar language merely to collect belongings. Employment compensation, work-related death benefits, tax, social insurance and succession can involve different legal regimes; obtain qualified advice when entitlement, debt or authority is disputed.
Treat housing, bank, property and digital accounts as estate matters
A lease, utility account, bank account, mobile number, vehicle, company interest, safe-deposit box, personal device and online account do not close automatically when immigration or work documents are cancelled. Contact each institution's deceased-customer or legal service and ask what death proof, translation, kinship, probate, notarization, Apostille or court document it requires. Do not use the deceased's passwords or continue transactions merely because the family knows them.
Secure the home and make a witnessed inventory of personal property where lawful. Coordinate with the landlord, employer and family before moving items, and obtain receipts for storage or handover. Cross-border inheritance, Chinese real estate, company shares, debt, tax and access to financial or digital assets require qualified legal advice in the relevant jurisdictions. A consular letter or employer statement is not automatically an estate grant.

Protect sensitive information and representative authority
Medical, financial and identity information should be shared on a need-to-know basis. Create separate packets for public security, the work-permit authority, consulate, funeral operator, hospital, insurer, employer and lawyer. Redact unrelated information only where the receiving institution confirms that a redacted copy is acceptable. Avoid group chats containing full passports, medical records, bank details and family contacts.
Every agent should have a defined task and authorization. A translator translates; a funeral operator handles funeral logistics; an insurer reviews cover; HR manages employment records; a lawyer advises on legal rights. None should reuse the documents for another purpose without an appropriate basis. If an agent leaves the case, revoke access where possible and recover originals, account credentials and working copies.
Resolve a blocked cancellation by identifying the missing owner
If public security, the work-permit authority, hospital or employer says the file cannot proceed, ask for the exact missing document, incorrect field, authority question or jurisdiction problem. Record who issued the death proof, where the person was registered, where the employer is licensed and who currently holds the passport. A generic statement that the death is not in the system is not enough to identify whether the issue belongs to health, police, immigration or employment records.
Use the official service or complaint channel for that owner, not a mass escalation to every authority. Contact 12367 for immigration routing, the local work-permit authority for employment-system issues, the hospital's medical-record or finance office for provider files and the consulate for nationality-specific documents.
